Kudos to the EPA. Coal is dirty and nasty. It destroys our land when it's strip-mined and messes up the globe when it's burned.

Thanks for the book recommendation. I've often thought that maybe the climate crisis is really an ocean crisis. Have you read Sea Sick? One or two Amazon reviews say it is light on science.
I strongly disagree that those of us who fight against additional overhead on the economy are shills for the fossil fuel industry. I propose we outlaw coal generation outright over a 10-20 year period, and replace it with natural gas and nuclear. This will be much more effective at reducing CO2 and all the other coal-related nastiness, than the cap-and-trade bill now growing mold in the Senate.

Our country's energy policy should be above politics. Since the EPA actions to regulate CO2 will impact energy policy greatly, it deserves to have a fair hearing. By relying upon the United Nations' scientific opinion, as the EPA repeatedly did in their Technical Support Document (http://epa.gov/climatechange/endangerment/downloads/TSD_Endangerment.pdf), they compromised the sovereignty of the U.S. This is no small matter.
While I agree the U.S. Chamber of Commerce shot themselves in the foot by using the Scopes comparison, the fact is America needs our own objective, transparent climate commission to think-through climate change. Only then will Americans support CO2 regulation -- which now has nearly zero popular support.

Natural gas fired generation plants emit half the CO2 as coal. Yes, I am a Democrat who says "Drill, Drill, Drill." How else do we expect to escape the tyranny of Middle East oil and retire coal generation plants?
Respectfully I suggest you pay more attention to both sides of the discussion. I myself read the entire Climate Change 2007, the Fourth Assessment Report. Without question the fix was in. Six hundred twenty scientists participated in the body of the report, The Physical Science Basis portion. They made no conclusion as to whether CO2 is the primary driver of climate change. It was the Summary that concluded that CO2 is the primary driver. The Summary was written by 52 individuals--some employed by the UN; some not scientists. The Summary is not the consensus opinion of the 620 scientists as they were not asked to vote.
By the way, 1) 60 prominent German scientists have recently declared their dissent from man-made global warming fears in an Open Letter to German Chancellor Angela Merkel; 2) Eighty members and former members have recently called on the American Physical Society (APS), the nation's leading physics organization, to revise its pro-AGW position; and of course 3) several IPCC lead authors and expert reviewers are very critical of the IPCC process and conclusions (e.g. Dr. Richard S. Lindzen, John Cristy, Dr. Ross McKitrick, Dr. Madhav Khandekar).I stand by my post: America needs a Climate Truth Commission to determine if CO2 drives global warming or merely contributes to it.

A well written article, thanks. But what you see as a solution I see as a problem -- the IPCC.
I've read the IPCC reports with a critical eye and don't believe the conclusions reached by the IPCC are supported by the science in the reports. For instance, the scientists themselves identify a lot of problems and shortcomings with their own computer models. See the scientist's own words at http://energyplanusa.com/modeling_problems_energy_plan.htm
Global warming is here. That much is evident. But the key question is, "Does CO2 'drive' global warming or does CO2 merely 'contribute' to global warming?"
Sadly, the United States has out-sourced our scientific opinion on global warming to the United Nations. ...an organization more concerned about political influence and funding than conducting good science.
It's crystal clear. The United States needs our own objective, transparent climate commission to think-through global warming. We need the advice of a 'Climate Truth Commission' before we burden our economy with expensive energy. Both sides of the man-made global warming issue should welcome such an approach. ...since each is so darn sure of its facts.
